1. Who we are and your agreement
Trading Art Game (“the app”) is provided by norfstudios OÜ, a company registered in Estonia (registry code 17531670), registered office at Järvevana tee 9, Kesklinna linnaosa, Tallinn, Harju maakond, 11314, Estonia (“we”, “us”, “our”). By creating an account or using the app, you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use the app.
2. Eligibility
You must be at least 16 years old to use Trading Art Game. By using the app you confirm that you are 16 or over and that you are legally able to enter into this agreement.
3. Your account
You can create an account using an email address and password, or by signing in with your Google or Apple account. You are responsible for keeping your password and account access secure and for activity that happens under your Trading Art Game account. Please let us know promptly if you believe your account has been accessed without your permission.
You choose a public username. You must not choose a username that is offensive, misleading, impersonates someone else, infringes anyone’s rights, or breaches the standards in section 6. We may change or reset a username that breaks these rules.
4. Licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use Trading Art Game for your own private, non-commercial entertainment, subject to these terms. You may not copy, modify, reverse-engineer, resell, or exploit the app or any part of it except as the law expressly allows.
5. The game, credits and virtual items
Trading Art Game is free to download and play. The game includes virtual items such as in-game credits, packs, and paintings. These exist only inside the game.
- Virtual items and credits have no monetary value, are not your property, and cannot be exchanged, sold, or redeemed for real money or anything of real-world value.
- We grant you a limited licence to use virtual items within the game; we do not transfer ownership of them to you.
- Packs and similar features may award items on a randomised basis. The specific contents you receive are not guaranteed and have no cash value.
- We may add, change, remove, or reset virtual items, credits, prices (in credits), drop rates, and other game mechanics at any time to balance or maintain the game.
- Buying or selling accounts, virtual items, or credits for real money — whether inside or outside the app — is prohibited and may result in suspension or termination.
6. Acceptable use and community conduct
Trading Art Game has social and trading features. To keep them safe and enjoyable, you agree that you will not:
- harass, abuse, threaten, or harm other users;
- use offensive, hateful, sexual, or otherwise inappropriate content in usernames or anywhere you can enter text;
- impersonate any person or organisation, including us;
- cheat, use bots or exploits, or otherwise interfere with the fair operation of the game;
- attempt to access accounts, data, or systems you are not authorised to access, or disrupt the security or availability of the service;
- use the app for any unlawful purpose or in breach of these terms.
You can report inappropriate usernames or behaviour, and block other users, using the tools in the app. We may review reports and take action, but we are not obliged to monitor all activity.
7. Trading between players
The app lets you place paintings on a trade pile and send or accept trade requests with friends. Trades involve virtual items only. The app never facilitates payments or transfers of real-world money between users, and trading virtual items for real money — inside or outside the app — is prohibited. A completed trade is final. We are not a party to trades between users and are not responsible for them, but we may reverse or void trades that result from a bug, exploit, or breach of these terms.
8. Intellectual property
The app itself — including its software, design, logos, branding, text, and the “Trading Art Game” name — is owned by norfstudios OÜ or its licensors and is protected by intellectual-property laws. Nothing in these terms gives you any right in our intellectual property except the limited licence to use the app.
The artworks shown in the app are works of art that are in the public domain. The images we use are sourced from the open-access collections of museums and institutions that make them freely available for any use, including commercial use. These artworks are presented for cultural and entertainment purposes. The descriptions shown alongside them, and the titles we give the works, are our own editorial content written for the app, and may differ from those used by the source institutions. 9. Content you provide
The content you can create is limited (for example, your username). You are responsible for it and confirm you have the right to use it. By providing it, you grant us a licence to host and display it as needed to operate the app. We may remove content that breaches these terms.
10. Availability and changes to the app
Trading Art Game is still in development and is provided on an “as is” and “as available” basis. We may update, change, suspend, or discontinue the app or any feature at any time, and we may set or change limits on features. We will try to give reasonable notice of significant changes where we can, but we are not required to keep any particular feature available.
11. Suspension and termination
You can stop using the app and delete your account at any time (see our Privacy Policy and data-deletion form). We may suspend or terminate your access if you breach these terms, if your conduct harms other users or the service, or where we are required to by law. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
12. Disclaimers
To the fullest extent permitted by law, the app is provided without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or secure, or that any virtual items or progress will be preserved. This section does not affect any rights you have as a consumer that cannot be excluded under applicable law.
13. Limitation of liability
Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under mandatory law (including your statutory consumer rights).
Subject to that, and because Trading Art Game is provided free of charge, we are not liable for loss of virtual items, credits, progress, or data, or for any indirect or consequential loss, arising from your use of or inability to use the app.
14. Governing law and disputes
These terms are governed by the laws of Estonia, and the courts of Estonia will have jurisdiction over any dispute. If you are a consumer resident in the EU, the EEA, or the UK, you also keep the benefit of any mandatory consumer-protection rules of your country of residence, and you may bring proceedings in your local courts where the law allows.
EU consumers can also access the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the “last updated” date above and, where appropriate, notify you in the app. Your continued use of Trading Art Game after an update means you accept the revised terms.
